1. Who are we?
This webshop is operated by Arno Roelandts, sole proprietorship trading as Waplantikier, Sint-Corijnsweg 18, 1731 Zellik, company number 1042.296.969. You can reach us via our contact form or by email at info@waplantikier.be.
2. Scope
These terms apply to every order placed through this webshop. By ordering, you accept them. We may amend them; the version in force at the time you placed your order applies to that order.
3. Products and prices
We sell seed of peppers, sweet peppers and tomatoes in small packets. The seed is bought from a specialist supplier and divided into packets by us. Every batch receives its own lot number and a tested germination rate, with the date of the test. Photos of plants and fruit show how the variety can look and are for illustration only. Prices are in euros and exclude shipping costs, which are shown before payment. Special exemption scheme for small enterprises — VAT not applicable.
4. Ordering and payment
The contract is concluded once your order has been paid. Payment is made via Mollie. You will receive a confirmation by email. We only ship once payment has been received. One discount code may be used per order; discount codes cannot be combined with other discount codes or promotions.
5. Delivery
We only deliver to addresses within the European Union. Seed of tomato, sweet pepper and chilli pepper, among others, may only be placed on the market in the Union with a plant passport, and that passport is not valid outside the Union: there, every shipment requires a phytosanitary certificate. We do not fulfil orders with a delivery address outside the European Union; any amount already paid is then refunded in full.
We ship as a standard letter via bpost. A letter has no tracking. Shipping costs are shown at checkout. We deliver as quickly as possible and no later than 30 days after your order, unless otherwise agreed. The risk of loss or damage passes to you when you, or a third party designated by you other than the carrier, take physical possession of the shipment. If a shipment does not arrive, please let us know.
6. Plant passport and traceability
Every packet carries a European plant passport, stating among other things the lot number of the batch. As the plant health rules require, we record which batch went to which order. If a batch has to be withdrawn from the market for plant health reasons, we may contact you about it.
7. Germination rate, germination and harvest
The stated germination rate is the result of a test on the batch on the date shown. It is not a promise about the result of your own sowing. Whether seed germinates, and how a plant grows and yields, depends on growing conditions such as warmth, moisture, light, storage and time, over which we have no control. We therefore give no germination guarantee and no harvest guarantee. This does not affect your statutory rights, including the legal guarantee of conformity (clause 9).
8. Right of withdrawal
As a consumer, you have the right to withdraw from the contract within 14 days without giving any reason. The withdrawal period expires 14 days after the day on which you, or a third party designated by you other than the carrier, take physical possession of the shipment.
To exercise your right of withdrawal, use the withdrawal form on this website, our contact form, or send us another clear statement, for example by email. You may also use the model form below, but this is not obligatory.
Send the packets back no later than 14 days after your withdrawal. You bear the direct cost of returning them.
We will reimburse all payments received from you within 14 days of receiving your withdrawal, including the costs of standard delivery if you withdraw from the entire order. We may withhold reimbursement until we have received the packets back or until you have supplied evidence of having sent them back, whichever is the earliest. We will use the same means of payment as you used, unless you have expressly agreed otherwise.
An unopened packet is refunded in full. You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish their nature and characteristics. A packet of seed does not need to be opened for that: the details of the variety and the batch are on the label and on the product page. For traceability reasons, returned seed is never put back on sale. For an opened packet, we may therefore deduct the diminished value from the refund; this may amount to the price of that packet.

9. Conformity and complaints
You are entitled to the two-year legal guarantee of conformity from delivery. If something is wrong with your order, such as the wrong variety, a damaged packet or a shipment that did not arrive, let us know as soon as possible via our contact form, with your order number and, if it concerns the seed, the lot number. Please report a defect within two months of discovering it.
10. Governing law and disputes
These terms and every order are governed by Belgian law, without prejudice to the mandatory provisions that protect you as a consumer in the country where you habitually reside.
If you have a complaint, please contact us first and we will look for a solution together. If that does not work, you can turn to the Belgian Consumer Ombudsman Service.
